App Privacy Policy
Effective Date: 19 September 2024
1. Acceptance
This privacy policy (the “Policy”) applies to the collection, use, and disclosure of your information by Eightrack Media Inc. o/a Digital Hub—a company incorporated in the Province of Ontario—and our affiliates, as well as their successors and assignees (“Digital Hub”, “we”, “our”, or “us”), through our Apps made available through the Shopify App Store. This Policy forms part of, and is incorporated by reference into, the terms-of-use agreement for our Apps (the “Agreement“).
Capitalized terms not otherwise defined in this Policy have the same meaning as in the Agreement.
2. Collection and Use
of Personal Information
Each of our Apps collects, stores, and uses your information differently. Once you have uninstalled an App, your Merchant Data will be deleted within thirty (30) days.
2.1 Digital Hub Agency Tools
Shop Information
This App has read access to your Store’s shop information including the Store’s primary address, phone number, domain name, location, as well as the owner’s name and email address. This information is used to identify the Store, to customize the App’s functionality, as well as to help identify Support requests. Your name and email address is used to contact you with notifications and status updates related to the app. Your Store’s general information is stored in a database, and is updated automatically when changes are made in Shopify.
Products and Variants
This App has read access to your Store’s product information including product titles, descriptions, prices, types, vendors, and SKUs, as well as variant options. This information is used to provide comprehensive exports of product types, vendors, and tags. Product information is stored in a database, and is updated automatically when changes are made in Shopify.
Collections
This App has read access to your Store’s collection information including collection titles, descriptions, conditions, templates, and handles. This information is used to provide a comprehensive collection export. Collection information is stored in a database, and is updated automatically when changes are made in Shopify.
2.2 Digital Hub New Arrivals
Shop Information
This App has read access to your Store’s shop information including the Store’s primary address, phone number, domain name, location, as well as the owner’s name and email address. This information is used to identify the Store, to customize the App’s functionality, as well as to help identify Support requests. Your name and email address is used to contact you with notifications and status updates related to the app. Your Store’s general information is stored in a database, and is updated automatically when changes are made in Shopify.
Products and Variants
This App has read access to your Store’s product information including product titles, descriptions, prices, types, vendors, and SKUs, as well as published dates. This information is used to identify “new arrival” products, based on your configuration of the App. Product information is stored in a database, and is updated automatically when changes are made in Shopify.
Collections
This App has read and write access to your Store’s collection information including collection titles, descriptions, conditions, templates, and handles. This access is used to create new collections, and to modify existing collections. Collection information is stored in a database, and is updated automatically when changes are made in Shopify.
3. Support Requests
When you submit a Support request, we may collect, store, and use any details you provide in your inquiry—or any communications with us—including, but not limited to, your name, email address, and phone number.
4. General Uses
of Information
By submitting the information to us, whether through the Apps or a Support request, you are consenting to our use of this information in accordance with this Policy until you revoke your consent in writing.
If we collect personal information as defined by Canada’s Personal Information Protection and Electronic Documents Act (“Personal Information”), we do so in accordance with Canadian privacy laws, and ensure that all third parties (such as service providers, prospective investors in our business, and prospective purchasers of all or any portion of our business) who have contact with your data, have promised to comply with those laws as well.
We may use your Merchant Data to:
- administer our programs, including the management of your account, developing improvements to the Apps and Support, and creating new Apps;
- provide anonymized marketing and demographic information to our partners, and prospective partners;
- respond to your inquiries;
- communicate with you for purposes related to the Apps or Support;
- inform you of other products or services available from us;
- send you surveys regarding current Apps or Support, or new Apps that we are developing;
- communicate information and offers to you; and,
- understand and analyze your needs and preferences.
You understand that your (encrypted) Merchant Data may be transferred to third-party Sub-Processors, and involve:
- transmissions over various networks inside and outside of Canada; and,
- changes to conform and adapt to technical requirements of connecting networks or devices.
We do not sell, rent, or lease Merchant Data to third parties, except for a sale as part of a bona-fide re-organization, or acquisition of all or any portion of our business, in which case we will ensure that all third-parties involved are bound by confidentiality and non-disclosure terms consistent with this Policy and the Agreement. In the event of the completion of such a sale, you will be notified as required by the Agreement.
We will give you notice and obtain your consent before using or disclosing Personal Information for any purpose that is not described in this Policy.
5. Retention Period
of your Personal
Information
We will not retain your Personal Information longer than is necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). How long we retain your Personal Information depends on the type of data and the purpose for which we process your data.
If we have no ongoing legitimate business need to process your Personal Information, and to the extent required by law and our agreements with Shopify, we will either delete or anonymize it, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.
6. Security of your
Personal Information
We are committed to protecting the security of your Personal Information. We use a variety of security technologies and procedures to help protect your Personal Information from unauthorized access, use, or disclosure. For example, we store the Personal Information you provide on computer systems with limited access, which are located in controlled facilities. When we transmit your Merchant Data (including your Personal Information) over the Internet, we protect it through the use of encryption technologies, such as the Secure Hypertext Transfer Protocol (HTTPS).
7. Changes to
this Policy
We may revise this Policy at any time by updating this posting and providing a notification to you by popup/email that this Policy has been revised. The date that this Policy was last updated will appear at the top of the Policy. Continued use of an App after the date of the notice will signify your acceptance of the revised Policy. You should visit this page periodically to review this Policy.
8. No Liability
for Third Parties
We disclaim any and all liability for the acts, omissions, and conduct of any third party related to this Policy. Under no circumstances will we, our employees, officers, directors, agents, licensors, or their respective successors and assigns, be liable to you for any injury, loss, damage, or expense arising in any manner whatsoever from:
- the acts, omissions, or conduct of any third party; or,
- any access, use, reliance upon, or inability to use any third party materials, content, goods, or services located at, or made available at, our Apps or Support,
… regardless of the cause and whether arising in contract, tort, or otherwise. The limitations in this Section apply even if we knew of, or ought to have known of, the possibility of such damages in advance.
